1. INTRODUCTION. Modelithics, Inc. (Modelithics) is committed to respecting the privacy rights of its customers, visitors, and other users of the Modelithics websites. We created this Online Privacy Policy ("Privacy Policy") to give you confidence as you visit and use the Site, and to demonstrate our commitment to fair information practices and the protection of privacy. We have implemented this Privacy Policy for the Modelithics Website (www.modelithics.com). This Privacy Policy is not applicable to any other websites that you may be able to access from the Site, each of which may have data collection, storage, and use practices and policies that differ materially from this Privacy Policy. 3. INFORMATION COLLECTION PRACTICES

3.1. TYPES OF INFORMATION COLLECTED

(a) TRAFFIC DATA COLLECTED. We automatically track and collect the following categories of information when you visit our Site: (1) IP addresses; (2) types of computers accessing the Site; and (3) types of web browsers used to access the Site (collectively "Traffic Data"). Traffic Data is anonymous information that does not personally identify you but is to better understand and serve your needs and for improving your experience on the Site. We also use "cookies" to obtain certain types of information when your Web browser accesses Modelithics website. Modelithics uses log files to analyze and administer our Site. Users remain anonymous in our website log files unless they have created a website account and logged into our website.

(b) PERSONAL INFORMATION COLLECTED. In order for you to access certain parts of our Site, such as product downloads or the Literature area, we require you to provide us with certain information that personally identifies you ("Personal Information"). For example, individuals can sign up on a mailing list using the registration form on our website. (a) COMPANY USE OF INFORMATION. Modelithics maintains e-mail lists to keep registered persons informed about our company, events and product updates. We use Personal Information to fulfill your requests, or to contact you when necessary. We may also use your Personal Information to send you information that you requested, or to confirm purchases, or service request submissions. We may use your e-mail address to notify you of products or services that may interest you, such as to keep you informed about events or other items of interest, to notify you of recent updates to our Site, or to provide you with product news notification (such as patch releases). You may opt-out from our mailing lists by replying to the email message asking to unsubscribe or by going to http://www.modelithics.com/remove.asp website and checking the Unsubscribe checkbox. These opt-out procedures may not be available for transactional or relationship messages, such as e-mails that are necessary to provide you with confirmation of a completed transaction (such as a purchase or service request), to provide you with warranty information regarding a particular product you purchased, provide notification of changes of terms of service, or to provide you with important information about the use of a product that you have purchased or software that you have downloaded. However, we may need to provide your Personal Information to our partners or representatives ("third parties") in order to better serve our customers.

(c) USER CHOICE REGARDING COLLECTION, USE, AND DISTRIBUTION OF PERSONAL INFORMATION. You may choose not to provide us with any Personal Information. In such an event, you can still access the Site; however you will not be able to access and use those portions of the Site that require your Personal Information. 4. CONFIDENTIALITY AND SECURITY OF PERSONAL INFORMATION. Except as otherwise provided in this Privacy Policy, we will keep your Personal Information private and will not share it with third parties, unless we believe in good faith that such disclosure is necessary to: (a) comply with relevant law or to respond to a court order or other legal process served on Modelithics; (b) protect and defend our rights or property; (c) enforce our Terms of Service; or (d) enforce our Software License Agreement. Your Personal Information is stored on secure servers that are not accessible by third parties.

4.1. USER ABILITY TO ACCESS, UPDATE, AND CORRECT PERSONAL INFORMATION. We realize that your Personal Information, including your name, company, and e-mail address, is subject to change. To the extent that you do provide us with Personal Information, we wish to maintain its accuracy. We maintain a procedure in order to help you confirm that your Personal Information remains correct and up-to-date. At any time, you may visit your personal profile at www.modelithics.com. Through your personal profile you may review and update your Personal Information that we have already collected.

4.2. LOST OR STOLEN INFORMATION. You must promptly notify us if your user name or password is lost, stolen, or used without permission. In such an event, we will remove that user name, or password from your account and update our records accordingly.

4.3. PUBLIC INFORMATION. The Site contains links to other websites. We are not responsible for the privacy practices or the content of such websites. Our provision of a link to any other website or location is for your convenience and does not signify our endorsement of such other website or location or its contents. We have no control over, do not review, and cannot be responsible for, these outside websites or their content. Please be aware that the terms of our Privacy Policy do not apply to these outside websites.

5. UPDATES AND CHANGES TO PRIVACY POLICY. We reserve the right, at any time and without notice, to add to, change, update, or modify this Privacy Policy, simply by posting such change, update, or modification on the Site and without any other notice to you. Any such change, update, or modification will be effective immediately upon posting on the Site. If you object to any such changes, you must cease using the Site. Continued use of the Site following notice of any such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
